Loan Offerings:
We specialize in providing first-position loans secured by prime location, income-generating real estate. Our terms to borrowers include:
– 50% Loan-to-Value ratio, with valuations conducted per – transaction.
– Annual interest rates ranging from 12% to 18%, determined through rigorous due diligence.
– Monthly interest-only payments with a balloon payment at loan maturity.
– 12-month prepayment penalty.
– Guarantee Trust over property titles serving as collateral.
– Maximum loan term of 36 months, extendable up to 24 months with an optional 12-month extension provision.
Investment Structure:
Our investment structure is straightforward for syndicated and individual loans:
Debtors execute a Loan Agreement alongside a Collateral Agreement, which may be a Guarantee Trust Agreement (where the property title is transferred to a trustee for the loan duration) or a Mortgage, both registered in Costa Rica's National Registry of Property.
For ongoing transactions, TVB Capital retains the role of creditor and has the contractual right to partially or fully transfer its rights to a third party. In scenarios where you or a designated entity invests $100K in a $200K loan, an Assignment Agreement is signed, transferring 50% of creditor and beneficiary rights to you. This formalizes your status as a creditor entitled to corresponding interest payments.
Our affiliated ILA Accounting team handles collections, tax filings, payments, and distribution of proceeds as per the Assignment Agreement, which incurs a $75 service charge. Services include billing, statement issuance, tax preparation, tax payment from interest earnings, and proceeds deposition to you.
In compliance with Costa Rican regulations, default interest cannot exceed 30% on top of the current interest rate, with an additional flat $100 fine per late payment.
Non-payment for three months triggers foreclosure proceedings. Guarantee Trust foreclosures typically conclude within 9 days via a private process conducted by a Notary Public. Mortgages involve a longer legal process exceeding 9 months in court, thus we generally prefer the Trust option. Post-foreclosure, we leverage our property management company and collaborate with sales agencies to manage, rent, or sell acquired properties.
TVB Capital adheres to stringent compliance regulations, conducting comprehensive AML/KYC due diligence for debtors and payment processing. - *Statements:* Monthly transaction statements are provided to each creditor, detailing their respective balances.
